Problematic Issues of Guaranteeing Property and Personal Non-Property Rights of Victims within Criminal Proceedings

The problematic issues of guaranteeing compensation property and personal non-property rights (moral damage) to victims within criminal proceedings have been studied. author has analyzed international legal acts, national criminal, procedural civil legislation, law-enforcement court practice generalized by the Supreme Court Ukraine concerning bases duty claim victim interrogator, investigator prosecutor, when suffered material moral damage caused crime misdemeanor. studied issue genesis introduction into legislation provisions on implementing victims. A number inconsistencies, gaps shortcomings current specified issues, in particular taking account existing new market relations society, which prevents effective reliable for both individuals entities.
